Our Commitment to Your Privacy

Kennedy Pharmacy is a Health Information Custodian under Ontario's Personal Health Information Protection Act (PHIPA) and also complies with Canada's Personal Information Protection and Electronic Documents Act (PIPEDA) where applicable. We take our responsibility to protect your personal and personal health information seriously, and this policy explains how we collect, use, disclose, and safeguard it.

This policy applies to information we collect through our pharmacy operations, our website, online forms, chat, SMS, email, and any other channel through which you communicate with us.

Breach Notification

In the event of a privacy breach involving your personal health information, we will:

  • Notify you at the first reasonable opportunity, as required by PHIPA s. 12(2)

  • Notify the Information and Privacy Commissioner of Ontario (IPC) where the breach meets the prescribed thresholds under O. Reg. 224/17

  • Notify the Office of the Privacy Commissioner of Canada for breaches involving other personal information where there is a real risk of significant harm, as required under PIPEDA

We will also take appropriate steps to contain the breach, investigate its cause, and prevent recurrence.

Your Rights

You have the right to:

  • Access the personal information we hold about you

  • Correct inaccurate or incomplete information

  • Withhold or withdraw consent to specific collections, uses, or disclosures (subject to legal and clinical limitations)

  • File a complaint with our Privacy Officer at admin@kennedypharmacy.ca

  • Escalate a complaint to:

    • The Information and Privacy Commissioner of Ontario at ipc.on.ca — for health information matters

    • The Office of the Privacy Commissioner of Canada at priv.gc.ca — for other personal information matters

We will respond to access and correction requests within 30 days, as required by PHIPA, and may extend this period only where permitted by law.

Others

Retention

We retain personal health information for a minimum of 10 years after the last patient interaction, in accordance with Ontario College of Pharmacists requirements. Other personal information is retained only as long as necessary for the purposes for which it was collected or as required by law.

Cookies and Website Analytics

Our website uses cookies to enable core functionality and to understand how visitors use the site. We do not use cookies to sell or share behavioural data with advertisers. You may disable cookies in your browser settings, though some site features may not function properly as a result.

Consent

Under PHIPA, we rely on your implied consent to collect, use, and disclose personal health information for the purposes of providing health care within your circle of care (e.g., your physician and other treating providers). For uses or disclosures outside the circle of care — such as marketing, research, or fundraising — we will obtain your express consent.

You have the right to withhold or withdraw consent ("lockbox") for specific uses or disclosures of your health information. Please note that withdrawing consent may affect our ability to provide certain services or coordinate care with other providers. To exercise this right, contact our Privacy Officer.

How We Use Your Info

We do not sell your personal information. We share it only when:

  • It is part of providing care within your circle of care (physicians, other healthcare providers)

  • We are submitting claims to government drug programs or private insurers

  • We engage third-party service providers to support our operations (e.g., secure communications, dispensing software, payment processing). These providers act as our agents under PHIPA, are bound by written agreements, and are required to protect your information to the same standard we do.

  • We are required or permitted to disclose information by law, court order, or regulatory authority (e.g., Ministry of Health, College of Pharmacists)

  • You have given us consent
